EU Tightens the Leash on Meta: WhatsApp Channels Now Under Strict Regulatory Oversight

BRUSSELS – The European Union has officially escalated its oversight of Meta’s WhatsApp, designating its “Channels” feature as a Very Large Online Platform (VLOP). The decision, announced on January 26, 2026, places the service under the most stringent tier of the Digital Services Act (DSA), effectively treating it with the same level of scrutiny as Facebook, TikTok, and X.

The classification comes after WhatsApp reported that its Channels reached over 51.7 million monthly active users in the EU—comfortably surpassing the 45-million threshold that triggers federal intervention.

Privacy vs. Public Broadcasts

In a move to reassure privacy advocates, the European Commission emphasized that this new legal regime is strictly targeted. While the “Channels” feature—used by news outlets, celebrities, and organizations to broadcast to the masses—must now undergo rigorous monitoring, the app’s core private messaging service remains untouched.

“The end-to-end encrypted private chats are explicitly exempt,” officials clarified. This means that while your personal messages remain private, the public-facing feeds you follow will now be held accountable for the spread of disinformation and illegal content.

A Four-Month Deadline

Meta now finds itself in a race against time. The company has exactly four months—until mid-May 2026—to implement a comprehensive risk-management strategy. Failure to comply with the DSA could prove catastrophic, with potential fines reaching up to 6% of Meta’s global annual turnover.

According to the EU, Meta must now:

  • Mitigate Systemic Risks: Actively prevent the manipulation of elections and protect fundamental rights.

  • Curb Illegal Content: Strengthen moderation tools for public channels.

  • Enhance Transparency: Provide detailed reports on how algorithms and content are managed.

WhatsApp’s Response

In a statement following the announcement, WhatsApp spokesperson Joshua Breckman affirmed the platform’s commitment to the region. “As Channels continues to grow globally, we remain dedicated to evolving our safety measures to align with regulatory expectations while maintaining our responsibility to our users,” Breckman said.

The move marks another chapter in the EU’s aggressive campaign to rein in Big Tech, following a record €120 million fine imposed on Elon Musk’s platform, X, just months prior.
